The short version. Omigacha is free to play. You can buy Crystals with real money; Crystals and everything you get with them are a licence to use in-game content — they are not your property and have no cash value. Summons are random and the odds are published in the game. Be decent in chat. Don’t cheat. You can delete your account whenever you like. Nothing in this summary replaces the full terms below, and none of it takes away rights the law gives you as a consumer.

1. Who we are, and who these terms are with

Omigacha (the “Game”) is published and operated by Filip Gorka trading as Nascorart, a sole trader, of Lytchett House, 13 Freeland Park, Wareham Road, Poole, Dorset BH16 6FA, United Kingdom (“we”, “us”, “our”).

These Terms of Service (the “Terms”) are a contract between you and us. They are not a contract with Apple or Google — see section 17.

2. Accepting these terms

You accept these Terms when you tick the box in the Game before playing. We record that acceptance, together with the version of these Terms and of our Privacy Policy that you accepted, and the date and time. If you do not accept, you cannot play.

If we make a material change we will ask you to accept the new version the next time you open the Game. Minor corrections (typos, formatting, clarifications that do not change your rights) may be made without asking again.

3. Who may play

If we learn that someone under 13 holds an account, we will close it and delete the associated data.

3.1 A note for parents and guardians

The Game contains optional purchases of randomised virtual items. Both Apple and Google provide device-level parental controls that can require a password for every purchase or block purchases entirely. We strongly recommend using them. If a child has made purchases without your permission, contact the relevant store (they process the payment and control refunds) and contact us — we will help where we can.

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the Game for your own private, non-commercial entertainment. We keep all other rights. You may not:

6. Virtual items and virtual currency

The Game contains Crystals (bought with real money or earned), Gems and Gold (earned in play), Capsules, monsters, runes and other virtual items (together, “Virtual Items”).

Virtual Items are a licence, not property. When you obtain a Virtual Item you receive a limited, personal, revocable licence to use it inside the Game. You do not own it. It has no monetary value, is not your property, is not a bank balance or any kind of financial instrument, and cannot be redeemed for cash or anything of real-world value.

7. Purchases, prices and refunds

7.1 How buying works

All real-money purchases are processed by Apple (App Store) or Google (Google Play), under their own terms. We never see or handle your card or payment details. The price, including applicable tax, is shown by the store before you confirm.

7.2 Your right to cancel — and why it usually ends immediately

If you are a consumer in the UK or the EU, you normally have 14 days to cancel a purchase of digital content. That right is lost once supply has begun, provided you gave prior express consent to immediate supply and acknowledged losing the right.

Because Crystals are delivered to your account instantly, the Game asks you to give exactly that consent and acknowledgment before each purchase. By confirming, you ask us to supply the Crystals immediately and you accept that you thereby lose your 14-day right to cancel. We record that confirmation.

This does not affect your rights if something goes wrong — see 7.4.

7.3 Refunds

Refund requests are handled by the store you bought from, under its policy: Apple / Google Play. We can rarely reverse a store purchase ourselves. If you did not receive Crystals you paid for, contact us and we will investigate and put it right.

7.4 Faulty digital content

Nothing above affects your statutory rights. In the UK and the EU, digital content must be as described, fit for purpose and of satisfactory quality; if it is not, you may be entitled to a repair, a price reduction or a refund regardless of section 7.2.

7.5 Monthly spending limit for players under 18

If you are under 18, the Game limits how much real money you can spend in a calendar month:

The limit is based on the age you gave us and resets at the start of each calendar month. Because the app stores charge in your local currency, the limit is applied against approximate US dollar prices, so the exact figure in your currency may vary slightly.

This is a limit we impose on ourselves as a protection, not a legal ceiling. It works by preventing a purchase from starting — we cannot stop Apple or Google taking a payment once it has begun. If you reach the limit, the Game will tell you and you can buy again next month.

8. Randomised items (“loot boxes”) and published odds

Summons, Capsules and the Daily Bonus wheel give randomised rewards. The chance of each outcome is published inside the Game and is viewable before you spend anything — look for the “?” button on the Summon screen and on the Daily Bonus window. The published odds match the rates the Game actually uses.

The Game also applies guarantees, published alongside the odds: at least one ★★★ Rare or better in every 10-pull; a rising Legendary chance from 50 pulls without one; and a guaranteed Legendary at 100. Your pull counter is shown on the Summon screen and does not reset between sessions.

Random means random: outside those guarantees, a purchase may produce an outcome you did not want, and past results do not change future chances. Please treat purchases as spending on entertainment, not as an investment or a wager.

9. How you must behave

The Game has public world chat, guilds and player-versus-player features. You must not:

10. Chat, names and other content you post

You keep ownership of what you post. By posting it in the Game you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and transmit it for the purpose of operating, moderating and promoting the Game. This licence ends when your content is deleted, except for copies we must keep for legal or moderation records.

11. Availability

We work to keep the Game available but we do not promise it will be uninterrupted or error-free. We may suspend it for maintenance, updates, or technical or security reasons. Features may change over time.

12. Suspension and termination

12.1 By you

You may stop playing at any time, and you may delete your account and its data from Settings → Delete Account in the Game, or via our deletion page if you have already uninstalled it.

12.2 By us

We may suspend or close your account if you materially break these Terms — for example cheating, abuse, or real-money trading. Where it is reasonable and lawful to do so we will tell you why and, for anything short of serious or repeated breach, give you a chance to put it right. You can appeal any decision by emailing us; we will look at it again.

12.3 What happens then

When an account ends, the licence to its Virtual Items ends with it and unused Virtual Items are lost. If we close your account for a reason that is not your fault, or you close it because we broke these Terms, you may be entitled to a refund for unused paid Crystals — contact us.

13. If the Game closes

Online games do not last forever. If we decide to shut the Game down we will give at least 30 days’ notice in the Game and on our website, and we will stop selling Crystals from the moment that notice is given. Virtual Items cannot be refunded merely because the Game has closed, except where consumer law in your country says otherwise — and this paragraph does not limit those rights.

14. Disclaimers

The Game is provided “as is” for entertainment. To the fullest extent the law allows, we exclude implied warranties that the Game will be uninterrupted, error-free, secure, or fit for any particular purpose. Nothing here removes rights you have as a consumer that cannot be excluded by law.

16. Your responsibility to us

If you break these Terms deliberately or carelessly and that causes us loss — for example a third-party claim arising from something you posted — you are responsible for that loss to the extent it was caused by you. This does not apply to anything you did that was reasonable or that we asked you to do.

17. Apple and Google

These Terms are between you and us only. Apple and Google are not parties to them and are not responsible for the Game.

18. Governing law and where disputes are heard

These Terms are governed by the laws of England and Wales.

If you are a consumer, this does not take away your local protections. You keep the benefit of any mandatory consumer-protection rules of the country where you live, and you may bring proceedings in the courts of that country. We will only bring proceedings against you in the courts of the country where you live.

Please contact us first — almost everything is solved by email. If we cannot resolve it, consumers in the EU and the UK can also approach the consumer-dispute or alternative-dispute-resolution body in their own country.
